This Site is owned and operated by Cranial Prosthesis & Hair Loss Solutions, LLC. d.b.a. You Again Boutique. This Site is NOT an ecommerce website, and no products or services can be bought or sold via the Site.

By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

Intellectual Property
All content published and made available on our Site is the property of You Again Boutique and the Site's creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.

Acceptable Use
As a user of our Site, you agree to use our Site legally, not to use our Site for illegal purposes, and not to:

  • Harass or mistreat other users of our Site;
  • Violate the rights of other users of our Site;
  • Violate the intellectual property rights of the Site owners or any third party to the Site;
  • Hack into the account of another user of the Site;
  • Act in any way that could be considered fraudulent;
  • Post any material that may be deemed inappropriate or offensive;
  • For illegal or unauthorized purposes;
  • To solicit others to perform or participate in any unlawful acts;
  • To violate any international, federal, provincial or state regulations, rules, laws, or local ordinances;
  • To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
  • To upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service;
  • To collect or track the personal information of others;
  • To spam, phish, pharm, pretext, spider, crawl, or scrape;
  • To infringe upon or violate our intellectual property rights or the intellectual property rights of others;

If we believe you are using our Site illegally or in a manner that violates these Terms and Conditions, we reserve the right to limit, suspend or terminate your access to our Site. We also reserve the right to take any legal steps necessary to prevent you from accessing our Site.

  • Customer Reviews.

By posting publicly on our Site, you agree not to act illegally or violate these Terms and Conditions.

Sale of Goods And Services
These Terms and Conditions govern the sale of goods and services available on our Site.

The following goods are advertised on our Site, but not available for direct sale:

  • Hair prostheses (or cranial prostheses) - custom-made wigs specifically designed for patients who have lost their hair as a result of medical conditions or treatments.
  • Post-mastectomy custom fitted forms and bras
  • Post-mastectomy swimwear

The following services are advertised on our Site, but not available for direct sale:

The products and services are contracted directly with You Again Boutique and not via the Site. 

These Terms and Conditions apply to all the goods and services that are displayed on our Site at the time you access it. This includes all products listed as being out of stock. All information, descriptions, or images that we provide about our goods and services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods and services we provide. You agree to purchase goods and services from our Site at your own risk.

We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

Third Party Goods and Services
Our Site may offer goods and services from third parties. We cannot guarantee the quality or accuracy of goods and services made available by third parties on our Site.

User Goods and Services
Our Site may allow users to sell goods and services. We do not assume any responsibility for the goods and services users sell on our Site. We cannot guarantee the quality or accuracy of any goods and services sold by users on our Site. However, if we are made aware that a user is violating these Terms and Conditions, we reserve the right to suspend or prohibit the user from selling goods and services on our Site.

Payments
As a service provider we accept the following payment methods, but not directly on our Site:

  • Credit Card;
  • PayPal;
  • Debit;
  • Direct Debit;
  • Medical Insurance;
  • Sezzle;
  • Tricare; and
  • CareCredit.

When you provide us with your payment information, you authorize our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorize us to charge the amount due to this payment instrument.

If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

Shipping and Delivery
When you purchase goods from our Site, the goods will be delivered through one of the following methods:

  • For all custom cranial prosthetics, please allow up to 6 weeks to custom make your unit, package, and ship. Special builds can take up to 12 weeks. If your cranial prosthesis is likely to take 12 weeks to make, you will be notified at the time of your initial appointments, or in writing or via email. Our units are carefully designed and constructed with the measurements and parameters that you provided to us, or taken during consultation. Please double check that you have the proper measurements before submitting them to us;
  • If you are ordering and need your wig or prosthesis in an expedited time frame, please contact us to see if we can honor your request: email info@youagainboutique.com; or phone +1 (901) 417-8928
  • We will notify you via email once your unit has shipped. Your tracking number will be provided.
  • For all non-custom cranial prosthetics (pre-made wigs), our certified fitters ensure sizing/fit, style, and customization need (for example hypoallergenic material, etc) during consultation. Delivery is often dependent on manufacturers' delivery guarantees, and can only be communicated to you at the time of the consultation
  • For post-mastectomy products we recognize and adhere to established guidelines and best practices 

Delivery will take place as soon as reasonably possible, depending on the delivery method selected. Delivery times may vary due to unforeseen circumstances. Please note that delivery times do not include weekends and statutory holidays.

You may be required to pay delivery charges in addition to the price for the goods you purchase.

If you purchase goods from us for delivery to a destination outside the United States your purchase may be subject to import duties and taxes applied by the destination country. You are responsible for paying any such duties or taxes. Please contact your local customs office for more information before making a purchase. We are not responsible for the payment of any such duties or taxes and are not liable for any failure by you to pay them.

You are required to provide us with a complete and accurate delivery address, including the name of the recipient. We are not liable for the delivery of your goods to the wrong address or wrong person as a result of you providing us with inaccurate or incomplete information.

Refunds

Refunds for Goods
Refund requests must be made within 5 days after receipt of your goods.

We accept refund requests for goods sold on our Site for any of the following reasons:

  • Good does not match description; or
  • If you believe your item is defective, damaged or if you receive the wrong item.

Refunds do not apply to the following goods:

  • Custom prosthetics are personalized to fit your measurements and cannot be resold or restocked;
  • Returns of gift cards cannot be accepted; and
  • Items must be in the original factory condition.

Refunds for Services
We provide refunds for services sold on our Site as follows:

  • You will also need the receipt or proof of purchase. Please note you are responsible for all shipping charges to return the item(s). There is a 15% restocking fee on returns.

Returns
Returns can be made by mail. To return a good by mail, follow the following procedure:
To start a return, you can contact us at info@youagainboutique.com . If your return is accepted, we will send you instructions on how and where to send your package. Items sent back to us without first requesting a return will not be accepted. You will also need the receipt or proof of purchase. Please see our REFUNDS policy before issuing a return.

To be eligible for a return, your item must be returned in the original, factory condition. Original factory condition means the item(s) is unaltered (which includes brushing, combing or cutting), unworn, undamaged, free of odors, with tags attached and in the original packaging. If any component is missing or altered no refund or exchange can be issued.

Due to the sanitary nature of wigs, hairpieces, and prosthetics these guidelines are strictly enforced.

Consumer Protection Law
Where any consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

Links to Other Websites
Our Site contains links to third party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any third party website or service linked to on our Site. It is your responsibility to read the terms and conditions and privacy policies of these third party websites before using these sites.

Limitation of Liability
Cranial Prosthesis & Hair Loss Solutions, LLC. d.b.a. You Again Boutique and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

Indemnity
Except where prohibited by law, by using this Site you indemnify and hold harmless Cranial Prosthesis & Hair Loss Solutions, LLC. d.b.a. You Again Boutique and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

Applicable Law
These Terms and Conditions are governed by the laws of the State of Tennessee.

  • We reserve the right to refuse service to anyone for any reason at any time.
    You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.
    Credit card information is always encrypted during transfer over networks.
    You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us;
  • ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION  
    We are not responsible if information made available on this site is not accurate, complete or current.
